Assault to female led to Roan Mountain shooting

The Roan Mountain man shot to death on Saturday was in the process of a domestic assault, according to the Carter County Sheriff’s Office.
Franklin Lee Hamby, 48, was found with a gunshot wound when deputies arrived at a residence at 120 Old Highway 19-E around 8:30 p.m. Hamby was pronounced dead at the scene.
According to investigators, Brandon Clarence Eklund, 34, shot Hamby. Eklund told officers he came to the aid of the female assault victim who had asked Hamby to leave the residence. Hamby refused, then picked up a baseball bat and threatened to attack Eklund and proceeded to advance toward Eklund with bat in hand, according to reports.
At that point, Eklund fired the fatal shot.
“Eklund has cooperated with our investigators, and due to the facts of the case he has not been taken into custody at this time,” said Public Relations Officer Thomas Gray with the sheriff’s department. “Our office and the District Attorney will present the facts of this case to the grand jury on May 22, and the grand jury will make the determination of whether charges will be filed.”
