Kidnapping charge dropped against defendant, remaining charges bound over to Grand Jury

A case against a Carter County man who faces multiple charges following a police pursuit is headed to the Grand Jury following a court hearing on Tuesday.
In April, deputies of the Carter County Sheriff’s Office arrested John C. Seth Holtsclaw, 21, of 115 West St., Roan Mountain, and charged him with kidnapping, evading arrest, reckless endangerment, resisting arrest, and driving on a revoked license. Deputies also issued Holtsclaw citations charging him with speeding, driving an unregistered vehicle, wrong registration displayed, and violation of financial responsibility.
Holtsclaw appeared in Carter County General Sessions Court on Tuesday for a preliminary hearing in his case. At the beginning of the hearing, Assistant District Attorney Ryan Curtis informed the court that the State was dropping the kidnapping charge against Holtsclaw but the remainder of the charges would be presented at the hearing.
During the hearing, CCSO Investigator Nick Andes took the witness stand to testify about the events leading to his arrest of Holtsclaw on April 28.
Andes said while he was on patrol in Roan Mountain on that date he saw a white Subaru traveling at a high rate of speed. When he attempted to stop the car, Andes said the driver failed to stop, turned onto a side road and accelerated. During the pursuit, Andes said the driver of the Subaru, who was later identified as Holtsclaw, tailgated another vehicle and nearly struck it several times.
The officer said he continued to pursue the vehicle as it pulled into a driveway and then went “off road” for a distance before coming to a stop. After the car had stopped, Andes said Holtsclaw fled on foot toward the woods, a male passenger got out of the back seat and fled in another direction, and a female passenger in the front remained in the car.
Andes pursued Holtsclaw and eventually was able to take him into custody.
After arresting Holtsclaw, Andes said he spoke with both the female passenger, identified as Charlie Hughes, and the male passenger who fled, who was then identified as a 17-year-old juvenile. Andes testified Hughes provided him with a written statement regarding the pursuit.
Under cross examination, Holtsclaw’s attorney, Greg Norris, asked Andes if he took a statement from the juvenile. Andes replied that he had spoken with the juvenile but did not take a statement from him due to him being a juvenile.
Following the hearing, Judge Keith Bowers Jr. bound the charges of evading arrest, reckless endangerment, resisting arrest, driving on a revoked license, speeding, driving an unregistered vehicle, wrong registration displayed, and violation of financial responsibility over to the Grand Jury. Holtsclaw is scheduled to appear in Carter County Criminal Court on Nov. 20.
