County man faces burglary, theft charges

A Biltmore man faces multiple charges after police say he burglarized a home and attempted to escape from police custody.

Deputies of the Carter County Sheriff’s Office arrested Jacob “Jake” Tyler Carty, 20, 149 Grandview Circle, Elizabethton, on Monday and charged him with theft of property under $1,000, two counts of burglary, resisting arrest, felony escape, and possession of Schedule II drugs (methamphetamine).

According to court documents, around 9:15 Monday morning deputies responded to a home on Gap Creek Road after a resident called 911 and reported he found an unknown man asleep in his vehicle.

Deputy Brian Smithpeters said when he arrived at the home he saw a man walking through the yard of the house next door carrying a grocery bag in his left hand and a beer in his right hand. Smithpeters spoke to the man, who identified himself as Carty.

“I asked Mr. Carty what he was doing in the backyard of the residence, and Mr. Carty stated ‘I am walking to my mom’s house next to the Sunshine Market,’” Smithpeters said. “Mr. Carty also stated ‘I was at a friends house last night and got messed up on nerve pills.’”

Deputies spoke with the man who called 911, who told the officers he was preparing to leave the house with his son and his son had walked outside before him. The son then came back into the house and told his father there was a man asleep in their vehicle.

The man went outside and found Carty lying in the back seat of his vehicle, and he appeared to be unconscious. He said Carty finally woke up and he told him to get out of the car. He said Carty wanted to borrow his phone but he told him no, and then told him which direction he needed to walk in order to get back to town.

According to court documents, the man said he then left his home with his son, but later returned to speak with officers.

While officers were speaking with Carty, Smithpeters said he spoke to Carty regarding the contents of the grocery bag, which was sitting on the ground. Smithpeters said the man who called 911 identified a Dewalt drill inside the bag as belonging to him. Officers searched the bag and located several items with the man who called 911 said came from his vehicle, his basement, his garage, and inside the living area of his home. Among the items which were found in Carty’s possession were the DeWalt drill, a Bosch drill set, a screwdriver, two padlocks, a box opener, a Swiss Army knife, a pocket knife, two fidget spinners, a Garmin GPS system, a Samsung Galaxy cell phone, and a Playstation 4 controller. The man also told officers the beer which Carty was holding when they arrived was taken from his refrigerator inside his home. The man told officers he thought he locked his doors when he left his home but he may have left one unsecured.

Deputies arrested Carty and placed him into Smithpeters’ police cruiser while they continued their investigation.

When searching Carty’s wallet, Smithpeters said he found two small plastic baggies containing a “crystal like substance” which tested positive for methamphetamine.

Smithpeters said while he was speaking with the man who called 911, Carty managed to get his hands from behind his back and roll down the window on his cruiser. Deputies then re-handcuffed Carty behind his back and placed him back into the police car. Minutes later, Smithpeters said Carty managed to once again get his hands in front of him then opened the door to the cruiser and took off running.

Deputies were able to catch Carty, who Smithpeters said struggled as officers attempted to once again handcuff him behind his back. After deputies had Carty back in custody, they transported him to the Carter County Detention Center.

Carty appeared in Carter County General Sessions Court Tuesday morning to be arraigned on the charges against him.

Judge Keith Bowers Jr. appointed the Public Defender’s Office to represent Carty and scheduled him to return to court on June 20.
